  • Just because your claim was denied doesn't mean that your veterans’ benefits claim isn't justified. There can be many reasons why your veterans' benefits claim was denied - and not all of them are valid.

Here are some of the common reasons we have seen for denial of veterans’ benefits:

    • The veteran did not submit enough supporting documentation and proof about their disability in their VA claim

    • You missed filing deadlines or exam appointments

    • The wrong forms were filled out

    • Your condition was determined to be pre-existing

    • You trusted the VA and handled the case yourself, without contacting a veterans’ lawyer or other advocate for guidance

The VA is a bureaucracy, and not easy to navigate if you are not experienced with government agencies and the legal system. We are a Veteran-owned law firm and understand the benefits you are entitled to for military service. We fight for the disability benefits you are entitled to because, for us, military service is personal.

  • Yes. The VA denies a large percentage of all benefits claims - and statistics show the highest percentage of cases allowed at the Board of Veterans Appeals are veterans with Attorney representation. When you are disabled and in need of need financial relief and medical care, it is important that you receive ALL the benefits you earned.

If your benefits claim to the Veterans Administration was denied, you need experienced, trustworthy legal representation to fight for your rights to overturn an adverse VA decision and approve your claim.

  • According to the VA’s 2020 report, almost 40% of all VA disability claims are denied:

VA Disability Appeals Approved at the BVA

    • 40.9% approved with an attorney

    • 33.0% approved with VFW representative

    • 31.7% approved with DAV representative

    • 31.8% approved with AMVETS representative

    • 26.2% approved with no representative

VA Disability Appeals Denied at the BVA

    • 14.8% denied with an attorney

    • 21.8% denied with VFW representative

    • 20.9% denied with DAV representative

    • 19.0% denied with AMVETS representative

    • 29.2% denied with no representative

  • Dealing with the Veterans Administration is difficult and challenging, as you already know. As an experienced veterans lawyer and veteran, I know first hand this will not be a fast process. Each state and territory has its own veterans disability claims office and its own timelines and caseload. A fast settlement with the VA will be 6-24 months, and sadly some cases take much longer.

We will do everything we can to expedite your case to bring it to a successful outcome and keep you informed every step of the way. We have years of experience in handling veterans’ claims and will put our knowledge to work for you.

  • The simple answer is no, you do not need a lawyer to file for VA benefits. However, the reality is 30% or more of all benefits claims are denied every year, and hiring a veteran’s lawyer provides you with the knowledge to help get your claim to be approved. And, if your claim was already denied, you need a knowledgeable vet’s lawyer to appeal and fight for your rights.

Filing a claim or an appeal takes a lot of time and a strong understanding of how the VA and the government work. We encourage you to talk to an experienced veteran’s lawyer who can explain your rights and the best way for you to get the benefits you deserve.

  • If your veterans' benefits claim was denied in error and you successfully appeal, you are entitled to retroactive back pay. You are eligible for back pay from the first day of the month following your “effective date” for benefits. The Veterans Administration calculates VA disability back pay as largely based on your application or approval date with some exceptions. If your claim is denied and you file an appeal, you can generally receive back pay if the VA approves your claim.
